Cloutier v. GOJET Airlines, LLC

On April 29, 2021, the United States Court of Appeals for the Seventh Circuit in Chicago, Illinois ruled in favor of the Plaintiff in the case of Cloutier v. GOJET Airlines, LLC. J. Arthur Smith III had acted as lead trial counsel for Mr. Cloutier and had obtained an award of $426,493.46 for his claims arising under the Family Medical Leave Act. The jury also found that the Defendant had acted in bad faith regarding its action under the FMLA and the court ordered GOJET Airlines, LLC to pay significant attorneys fees for efforts of Plaintiffs’ counsel. The Defendant appealed and the jury verdict as well as the rulings of the District Court. The Court of Appeals affirmed, except that the Court of Appeals awarded an additional $200,000-$300,000.00 in front pay to our client.
